[BUG] terms and condition switch

Already mentioned a few times in earlier versions:

When I switch of the checkbox for accepting the terms and conditions by customers in the config, they still get a checkbox presented at checkout.
The text label is gone, the checkbox not and it is mandatory to tick it before the client can procede.

Please correct because I get a lot fo confused customers. Since it is locked in the 'customer fields' too I don't dare to lift it out if my templates. :-)

I also pointed these bugs... some hack are possible.

Until now the option to avoid the TOS agreement is not working.
