3.3.5 ..and VM 2.9 plus . Agree to terms of service ..appears twice ?

The agree to terms of service appears twice when registering at the checkout.
Just wondering if it could only appear once ..

If you tick one the other disappears or shows it is already marked. Or say... You have agreed to the terms of service.

It shows up when I register as a customer .. Address and then when I save, it appears in the cart ?

But at the address level there is no link to the terms of agreement.  Everyone is just clicking both ..so no real issue .
