Terms and Conditions - new window not popup

Hi,

Site: www.firstmoments.co.nz
Joomla: 3.9.28
VM: 3.8.8

When going through the cart process - the "Click here to read T&Cs" link opens a pop up window, which in this case is difficult to read.

How can I change this so T&Cs open in a new Tab or Window rather than a pop-up?
Note I have checked the "config / checkout" and "config / shopper fields" options but can't any suitable options.

Suggest you fix the js error:
Uncaught TypeError: $.fancybox is not a function

Check settings under Core Css Styles & Javascripts in configuration.  This should make the popup stay live and maybe use css if still difficult to read.
