No system messages during checkout

I have changed my template to beez2, atomic and the issue still persists.
What I am experiencing are no system messages , errors, notices being displayed during checkout/cart . if you are supposed to get an error ( TOS not checked ) and go to another page, home page, or category, then you see the message as you would expect.

you can reproduce easily. http://www.thespicywench.com add a product to your cart, go to your cart, click the checkout button with out checking the TOS, you will be on the same page.. then click on the home button. the message appears.

Major problem..

Does anyone else have this issue? What could cause this? It makes no sense..
