Title: I got "Please agree to the Terms of Service" alert message even TOS is disabled

Hi,

I got "Please agree to the Terms of Service" alert message when saving Billing Address Information form/page even if I have disabled the terms of service in the configuration. I have also unpublished it from the shopper field. Any Idea?
