Title: Can't disable Terms of Service checkbox

I am running VirtueMart 3.0.8 in Joomla! 3.3.6. I have unchecked "Show Terms of Service on the cart/checkout" checkbox in the backend but the "Terms of Service" checkbox keeps appearing in the shopping cart. Does anyone know how to fix this?
