terms and services not visible on checkout page

Hi
I am using Joomla! 3.4.0 and VirtueMart 3.0.9. I can't seem to get the terms and conditions on the checkout page.
I have selected both: "Must agree to Terms of Service on EVERY ORDER" and "Show Terms of Service on the cart/checkout"
Anyone experienced similar issue or better still knows how to resolve?

Suggest you update first, as your Joomla version has security issues and there have been a lot of bug fixes since VM3.0.9 - current latest is 3.0.11.4

An update may fix your problem, but if it remains and you are using template overrides then test using the Protostar template.
